Lugano Plan ₿

Institute's Director Professor Crenguta Leaua was invited to lecture on the topic “ Disputes and Arbitration in the Blockchain Ecosystem” for the Lugano's Plan ₿ Summer School 2022 organised by the City of Lugano , Franklin University Switzerland , Tether.to with the collaboration of the USI Università della Svizzera Italiana, and a large number of important IT companies. A transformative project showing Lugano’s commitment and strategy in becoming a tech-leading city with an informed and skilled population, the Summer School is a two-week program, from the 3rd-16th of July, offering an understanding on blockchain, Bitcoin and cybersecurity, taught by leading world-class experts from around the world to students from 25 nationalities. With a competition for the best pitch with prizes for the top 3 teams who present the most innovative blockchain project, the summer school has captured both the attention of the participants but also of the industry so that a job fair is to follow at the end of student’s presentations. Legal thinking in the VR

Who ? What ? Where ? When? and, most of all, how is the relationship between humans different in the metaverse is the line of questions that need to be addressed for adapting the legal thinking to the new forms of reality - the virtual reality and augmented reality. "Blockchain, Metaverse and Arbitration" was the topic for discussion at this week’s #TagTime where the director of the Institute, Professor Crenguta Leaua joined Kabir Duggal, Ph.D. and Amanda Lee FCIArb for the Delos Dispute Resolution webinar series. The talk was an excellent opportunity to confirm the innovative approaches of Delos, a recipient of 2018 Global Arbitration Review Award for innovation. Metaverse: Conversations and insights

Professor Crenguta Leaua was featured in the in-depth interview series ‘’Conversations & Insights’’ hosted by Efi Pylarinou, one of the top world influencers in global finance and fintech and speaker on blockchain business trends. It was both an analytical and creative discussion, covering the topic “blockchain and metaverse" , where Professor Leaua considered the changes and opportunities for arbitration with advancements in AI, bringing insights from her participation in the events about blockchain during Davos 2022. Building on her article "The Greek Gods and the Metaverse: Legal Order in the Layered Universe", Professor Leaua highlighted the challenge the technological advancement brings to the legislation and policies that follow. EU trade and investment agreements

The European Commission has appointed Professor Crenguta Leaua as a member of the pool of individuals eligible for selection as arbitrators in bilateral disputes under trade agreements of the European Union with third countries. "Dispute settlement is an important element in ensuring the correct implementation of the EU’s trade and investment agreements with third countries. The European Commission is responsible for representing the EU in any dispute settlement procedures. Future of dispute resolution

Portland Communications invited director of The Swiss Institute of Alternative Thinking, Professor Crenguta Leaua to contribute to the 2022 edition of the prestigious Portland Communications’ Commercial Courts Report, with an analysis of the future of arbitration on the context of the anticipated use of artificial intelligence in commercial courts.

Augmented Reality

Augmented reality, its future possibilities and risks, the adaptation of the legal order and the role of education as to how it transitions from being a leisure activity into having a societal and business impact, are topics addressed by The Swiss Institute of Alternative Thinking member Crenguta Leaua, as a speaker in the Horasis Global Meeting panel ‘’The Good and the Potential Bad in Augmented Reality”. The Horasis Global Meeting is one of the foremost annual meetings of the world’s leading decision makers, bringing together more than 1000 selected world leaders and field experts from over 70 countries. This year’s edition took place online on 19.05.2022.

Innovation in the exploration of outer space

George Leaua, a member of The Swiss Institute for Alternative Thinking and researcher, has recently co-authored the paper „Innovation in the exploration of the outer space” published by the World Intellectual Property Organization (WIPO) as Economic Research Working Paper no. 71. The paper explores a series of innovations that made possible the exploration of outer space, and what impact such innovations have to this date on the overall advancement of technology. It also shows that the premise of any innovation is the ability to firstly perceive it as a possibility. ‘’A nation needs… political support, financial commitments, and a convincing argument that the technical knowledge and skills to complete the project are in the realm of possibility. If any one of those is not present, the proposed project will not be undertaken.’’ The expansion of this perceived„ realm of possibility” is precisely what the alternative thinking method aims to create, in order to enhance the capacity to innovative.

UNCITRAL ‘’Possible Future Work on Dispute Settlement’

At its fifty-fourth session the United Nations Commission on International Trade Law (UNCITRAL) Institute director, Professor Crenguta Leaua was invited as an expert to speak at the Colloquium on ‘’Possible Future Work on Dispute Settlement’’ on the sessions about Technology-related disputes. On March 30th, Professor Leaua reported on the work of the Silicon Valley Arbitration and Mediation Center (SVAMC) in blockchain-based transactions and today she is addressing the participants of the colloquium on the topics of ‘’Appointment of Experts” & “Confidentiality in the Context of Technology-Related Disputes’’. Along with other experts, Professor Leaua’s contribution assists the Commission in making informed decisions on the future legislative work in the area of dispute settlement.

Metaverse and Web 3.0

One of the purposes of The Swiss Institute of Alternative Thinking is to propose alternative perspectives and solutions in different versions of reality such as the newly announced Metaverse. Our member Crenguta Leaua is chairing the Metaverse debate: ‘’Will arbitration be the arena of the Web 3.0 conflict? A dispute resolution minefield coming from the future’’ at the 6th ICC European Conference, organised by The International Court of Arbitration during the Paris Arbitration Week, on 29 March 2022, in Paris, France. The Swiss Institute of Alternative Thinking is looking forward to seeing how alternative dispute resolution will impact and develop future virtual-reality spaces.

AI in dispute resolution

Our member Crenguta Leaua participated in the debate on the topic of ‘’Artificial Intelligence in Dispute Resolution’’, at the Schiefelebein Global Dispute Resolution Conference, organised by Sandra Day O’Connor College of Law at Arizona State University on January 14th 2022. The conference brings together notable lawyers, counsel for global corporations, internationally-recognised arbitrators and academics to discuss the future of AI’s use in ADR and features keynote speaker, Former Director of the FBI and Senior Research Scholar at Columbia Law School James Comey.

Conversational AI

The Swiss Institute for Alternative Thinking welcomed the new year by having institute director Crenguta Leaua speak on the topic of "Chatbots and their use in ADR’’ at the event organised on January 11th 2022, by Florida International University - College of Law and Miami International Arbitration Society. Prof. Leaua explored the ways chatbots can be used in alternative dispute resolution as they are a software that can successfully communicate with human beings and offer innovative solutions. In addition to the new uses of chatbots, the common legal issues that could arise from working with conversational artificial intelligence such as liability, consumer protection, privacy, cybersecurity, and human rights were also closely examined and discussed. This event demonstrates that The Swiss Institute for Alternative thinking is at the forefront of the legal and technological industry changes and it coincides well with the European Parliament’s and the Council of the European Union’s new regulation proposal that intends to harmonise the main issues related to artificial intelligence (Artificial Intelligence Act).
